The article focuses on two key issues. First, how advisory AI systems may tacitly become regulatory systems in practice. Second, if we aim to develop AI systems capable of making decisions of moral significance, which fundamental philosophical problems must first be addressed. These problems are organised around three main axes: the learning and incorporation of values and the prioritisation of decision-making criteria, the capacity to understand the concepts of ethics and justice, and the attribution of responsibility for the decisions and consequences arising from the operation of such systems. This paper explores the application of Aristotelian virtue, as a quality of excellence and as a key notion in ethics, to AI systems as classified in the EU AI Act.
